Criminal Appeals
New Jersey Criminal Appeal Attorney
If a person is convicted of a crime, our justice system gives them an opportunity to appeal his or her case. In most cases, a criminal appeal does not afford the convicted person the opportunity to challenge the facts of the case. Rather, a criminal appeal allows a skilled appellate attorney the opportunity to show that the trial court misapplied the law or erred its judgment.
WHAT DO I NEED TO DO IF I WANT TO APPEAL A CRIMINAL CONVICTION
The first thing you should do is hire a skilled criminal defense attorney who has the experience to handle appeals.
It is important to remember that you will not have an unlimited amount of time to file for an appeal. Every type of case has its only filing deadlines. For example, in New Jersey, you have 45 days from the date of the sentence to seek an appellate review of a Superior Court Conviction. In municipal court, the time is only 20 days from the date of the sentence. In some limited circumstances, a court may grant a 30 day adjournment if good cause is shown as to why a litigant could not comply with the original deadline.
